Explain the Care Act 2014

A

The Care Act 2014 sets out how care and support should be provided in England to adults with care needs, including older people.

  • Applied to England.
  • It followed a review that found the existing legislation to be insufficient.
  • Sets out how an individual’s care needs should be met.
  • Defines the responsibility of local authorities, e.g. the NHS - This includes safeguarding adults.
  • At the heart of the act is the “ wellbeing” principle.
  • Shift from response to prevention.

Promotes independance.

What is safeguarding ?

A
  • Safeguarding means protecting an adult’s right to live in safety, free from abuse and neglect.
  • It is about people and organisations working together to prevent and stop both the risk and experience of abuse and neglect while at the same time making sure that the adults well being is promoted and includeing their views, wishes and feelings.
  • It is about recognising that adults sometimes have complex interpersonal relationships and may be ambivalent, unclear, or unrealistic about their personal circumstances.

What are the principles of safeguarding?

A
  • Adults have the right to live in safety, free from abuse and neglect.
  • People are supported in making decisions that are in their best interest.
  • Any intervention should be the least restrictive of the adult’s freedom.
  • The adult should participate as fully as possible in any decision made.

What to say when someone wants to talk about abuse ?

A
  • Try to remain calm and non-judgemental.
  • listen and ask questions that help to clarify the facts eg “ tell me, explain, describe “ TED
  • Support them and reassure them.
  • Don’t make false promises, eg agreeing to intervene and keeping information secret.
  • Talk to supervising doctor or safeguard lead.

What to do if a vulnerable adult is at risk ?

A
  • Ensure the immediate safety of the person.
  • If urgent, call 999.
  • Discuss with your Supervising doctor
    -Could you discuss this with the safeguard lead?
  • if a crime has been committed call 101
  • Preserve any evidence
  • Make accurate records of what happened, decisions and actions.

A
  • Identify adults who may have safeguarding needs.
  • Respond to immediate risks.
  • Assess the individuals need.
  • Assess capacity.
  • respond to harm or abuse. eg be familar with safeguarding policies, know who your lead is.
