What is s47 OAPA 1861
Assault occasioning actual bodily harm
Define ‘assault’
Any type of common assault either assault or battery
Define ‘Occasioning’
Causation:
- factual ‘but for’ (pagett)
- legal ‘more than a slight or trifling link’ (kimsey)
Define bodily harm
Miller - any hurt or injury calculated to interfere with the health or comfort of v
Does psychiatric injury count as bodily harm?
Yes
Chanfook- not so trivial as to be wholly insignificant

Loss of consciousness even momentarily is held to be actual bodily harm
