Section 110 - Every search power authorises the person exercising it to:

  • Enter & seach place, vehicle, thing and items in that place vehicle or thing.
  • Request person to assist with entry and search.
  • Use reasonable force to property for search and seizure
  • Seize anything that is subject of the search or can be lawfully seized.
  • Bring and use equipment/use equipment found at place (use electricity)
  • Bring and use in place/vehicle a trained dog for the search.
  • Copy any document/part of document that may be lawfully seized.
  • Use reasonable measures to access computer system/storage device at vehicle place for intangible material that is subject of search.
  • Intangible material on computer/storage device can be copied.
  • Take photos, sound & video recordings & drawings of the place/vehicle/thing being searched.

  • Must RAN/RAIN
  • May detain person to enable search
  • May use reasonable force to detain for purpose or search
  • May use equipment to aid or facilitate search, (involves minimal/no contact)
  • Assistance of medical practitioner / guardian / parent
  • Strip search - Same sex
  • May seize any item carried by the person or in immediate control
  • May use reasonable measures to access computer system/storage device that is on the person/immediate control
  • Intangible material can be seized/copied etc
  • Rub down/strip search must be carried out with decency/sensitivity
