  • A persons political, religious or cultural beliefs.
  • A person sexual preferences.

A

Mental disorder, in relation to any person, means and abnormal state of mind (whether of a continuous or an intermittent nature), characterised by delusions, or by disorders of mood or perception or Volition or cognition, of such a degree that:

  • (A) poses a serious danger to the health or safety of that person or of others, or
  • (B) Seriously diminishes the capacity of that person to take care of himself or herself, and mentally disordered in relation to any such person, has a corresponding meaning.

A

A patient who is the detained by court order because they have been found to be criminally insane or unfit to plead. This also includes people who are on remand for psychiatric report.

What Is covered under section 41 of the mental health act 1992, assisting a DAO?

A

If a DAO is assessing a patient or transporting them for an assessment or treatment, they may call on a constable for assistance. This gives the constable powers to enter the premise where the person is and they may detained person to 6 hours, or the time it takes to conduct a medical examination.

They may also take the person to a place that they are required to attend.

What is covered under section 110C of the mental health act 1992?

A

Constable may be called upon to assist a medical practitioner who is acting under section 110, section 110A or section 110B of this act.

They made into premises where the person post patient is entertain them or take them to a place nominated by the medical practitioner entertain them there. The detention must not last for longer than six hours.
