What are the requirements to stop and ascertain injury? S22(1) LTA1998

A
  • when an accident arises from the operation of a vehicle to a person or vehicle
  • the driver or rider of the vehicle
  • must stop their vehicle
  • and ascertain whether anyone is injured
  • and render all practical assistance to anyone who is injure or killed

What are the penalties for failing S22(1) LTA1998?

A

• S35(1)(c) and (2) (non-injury)
3 months and/or $4500 - minimum 6 month disqualification mandatory

• S36(1)(a) and (2) (injury-death)
5 years and/or $20,000 - minimum 1 years disqualification mandatory

Duty to report injury?

A
  • where a crash involves
  • injury or death
  • the driver or rider must report the accident in person to
  • nearest Police station or an enforcement officer
  • as soon as but no later than 24 hours
  • unless the driver or rider is incapable by reason of injury.

A
  • Where a crash involves damage to
  • an unoccupied vehicle or other property
  • belonging to another person
  • the driver or rider
  • MUST unless incapable by injury
  • report within 48hours to the owner
  • drivers name, address, rego, crash location.
  • If owner can’t be contacted or identified
  • report to Police within 60hours.
