Detention in a Public Place
- behaving in manner that gives rise to a reasonable belief that he/she may be mentally disordered.
- after apprehension, arrange with DAO for assessment
- Police station should be last resort for an assessment

Assist Medical Practitioner
S110(c) entry power when urgent assistance is needed.
What is S41? MHA1992
Assisting a DAO (Private Address)
- so they may assess a patient or transport a patient
- enter premises by force if necessary and
- detain a person in those premises for the assessment examination or
- take a person to another place for the medical examination
What is the max time frame for a mental health detention?
6 hours (must record time of detention)

Detain and return to hospital
• compulsory treatment order patient = 3 months until invalid
• special = anytime
• restricted = anytime
What is a Special Patient? MHA1992
- are detained by the way of a court order if they are found to be criminally insane or unfit to plead.
- Also includes people on remand for a psychiatric report.
What is a Restricted Patient? MHA1992
- are subject to a compulsory treatment order but are considered to present a danger to the public
What is the definition of a Mental Disorder? MHA1992
Is defined as an abnormal state of mind (continuous or intermittent) characterised by delusions, or by disorders of mood, perception, volition or cognition of such a degree that it
- poses a serious danger to the health and safety of themselves or others, or
- seriously diminishes the capacity of that person to take care of themselves.
What is a Compulsory Treatment Order Patient? MHA1992
“In-Patient” and stays in psychiatric unit for treatment
“Out-Patient” lives at home and attends psychiatric unit for treatment
Who can apply for a person to undergo a compulsory assessment? MHA1992
Anyone over the age of 18, normally a relative or a doctor.
Police aren’t in a position to apply for anyone to undergo compulsory assessment
What is a DAO?
Duly Authorised Officers
