Land transfer Act- section 21 (1)
Initial driver responsibility is to…….
1) They must STOP their vehicle
2) Ascertain whether anyone is injured
3) Render practical assistance to anyone who is injured or killed.
Land transport act -Section 22(3)
What is duty to report Injury?
if crash involves injury or death a driver must
1) must report accident in person to nearest police station or to an enforcement officer
2) as soon as reasonably practical
3) and in any case not later than 24hrs after the time of the crash
4) unless driver is incapable of doing so by reason of injuries sustained by him/her in the crash.
Land Transport act 1998 -Section 22(4)
Where a crash involves damage to an unoccupied vehicle or damage to other property belonging to another person a driver must (unless incapable due to injury)….
1) Within 48 hours report to
2) Owner- Driver name,address, rego, crash location
3) If they can’t be identified report to police station or enforcement officer within 60 hours of time of crash.
