Burglary 1st and 2nd Degree
-Armed with a deadly weapon
-Assaults any person during the act
2nd degree is any act that doesn’t meet 1st degree.
Criminal Trespass 1st and 2nd
1st
-Knowingly enters or remains unlawfully in a building
2nd
-Knowingly enters or remains unlawfully on a premises
Residential Burglary
- A person is guilty of residential burglary if, with intent to commit a crime against a person or property therein, the person enters or remains unlawfully in a dwelling other than a vehicle.
Vehicle Prowling 1st and 2nd
1st
-He or she enters or remains unlawfully in a motor home or in a vessel equipped for propulsion by mechanical means installed sleeping quarters or cooking facilities.
2nd

- Taking of personal Property from another or his/her presence against his/her will by the use of immediate force, violence, or fear of injury to that person or property.
1st

Coercion
- By the use of a threat (to person or property), compels a person to do or not to do something
- Remember: A threat to control behavior
-Think: Bully
Kidnapping
-Intentionally abducts another
- Restrain + keep/hold in place unlikely to be found
- Restrain + use or threaten deadly force
1st
-Ransom
-Inflict bodily injury
-Cause mental distress
-Facilitate commission of any felony or flight thereafter.
2nd
- Abducts another under circumstances not amounting to 1st degree
Luring
- Person with the intent to harm health, safety, or welfare…. lures or attempts to lure a minor ( under16 ) or developmentally disabled person…. into a structure or obscured area, vehicle, or aware from a transportation terminal.

If he or she knowingly restrains another person
Rape 1st Degree
By forcible compulsion where the perpetrator or an accessory:
- Threat to use deadly weapon
- Kidnaps victim
- Inflicts serious bodily injury
- Feloniously enters a building or vehicle
- Date rape drug is used
Rape 2nd and 3rd Degree
2nd Degree
- When the victim is incapable of consent by reason of being physically helpless or mentally incapacitated
- Has supervisory authority
3rd Degree
- Where the victim did not consent as defined in *RCW 9A.44.010(7), to sexual intercourse with the perpetrator
- Where there is threat of substantial unlawful harm to property rights of the victim
Rape of a Child 1st Degree
Person has sexual intercourse with another who is less than twelve years old and the perpetrator is at least 24 months older than the victim
Rape of a Child 2nd Degree
Person has sexual intercourse with another who is at least twelve years old but less than fourteen years old and the perpetrator is at least thirty-six months older than the victim
Rape of a Child 3rd Degree
Person has sexual intercourse with another who is at least fourteen years old but less than sixteen years old and the perpetrator is at least forty-eight months older than the victim.
Sexual Misconduct With a Minor
- The person has, or knowingly causes another person under the age of 18 to have, sexual intercourse with another person who is at least 16 but less than 18 if the perpetrator is at least 60 months older than the victim.
- Person is a school employee
- Person is a foster parent
- Difference between 1st and 2nd is sexual intercourse vs sexual contact.
Sexual Misconduct With a Minor 2nd Degree
- The person has, or knowingly causes another person under the age of 18 to have, sexual contact with another person who is at least 16 but less than 18 if the perpetrator is at least 60 months older than the victim.
- Person is a school employee
- Person is a foster parent
- Difference between 1st and 2nd is sexual intercourse vs sexual contact.
Sexual Exploitation of a Minor
- Compels a minor by threat or force to engage in sexually explicit conduct, knowing that such conduct will be photographed or part of a live performance
- Aids, invites, employs, and authorizes of such acts
- Being a parent, legal guardian or person having custody or control of a minor
Forgery
- With intent to injure or defraud
- ## Falsely makes, completes, or alters a written instrument
