-s.8 Theft Act 1968
-AR:completed theft, force or threat of force, immediately before or at the time of the theft
-MR: force in order to steal
Completed theft.
-All elements of theft must be present before there can be a robbery
Corcoran v Anderton
-Theft was complete therefore there was a robbery. (was an appropriation even though the bag was not taken)
R v Waters
-Not a completed theft therefore not a robbery.
R v Dawson and James
-Force is an ordinary word and for the jury to decide.
R v Clouden
-Force can be indirectly applied to property being held by V for a robbery.
P v DPP
-Taking something out of someone’s hand is not considered force.
B and R v DPP
- No need to show the victim felt threatened/ Threat of force can be implied.
R v Hale
-Theft can be a continuing act.
R v Lockley
-Theft was still ongoing as D had not left the property.
