Robbery Flashcards
Robbery Definition:
A person is guilty of robbery if he steals
And immediately before or at the time of doing so and in order to do so
He uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force
Steals:
Same definition of theft. Therefore no theft no robbery.
Theft does not include TWOC or taking a pedal cycle without consent
Immediately Before:
A matter for the court to decide but there should be an UNBROKEN CHAIN OF EVENTS between force and theft
(Even if many hours have elapsed)
Or at the time of doing so:
NOT AFTER
And in order to do so:
The force or putting in fear of force MUST ENABLE A THEFT TO TAKE PLACE
NOT to make good an escape after the theft was committed
Uses force on any Person:
Very little FORCE is required and must be used voluntarily (still counts if reckless)
Fear of Force:
Must be at THAT TIME AND PLACE -> THEN AND THERE SUBJECTED TO FORCE
D only needs to intend to put the person in fear - not necessary they were actually frightened
A person CANNOT FEAR FOR THE SAFTEY OF ANOTHER PERSON
