Q

Force

A

e:
The jury decides whether the acts were force, using the ordinary meaning of the
word (Dawson)
 It includes wrenching a bag from a hand Clouden Immediately before or at the time of theft
 For robbery, theft has been held to be a continuing act - Hale
 Using force to escape can still be at the time of the theft – Lockley
 Threats of future force will not suffice for robbery.
 Must seek to put in fear of being ‘then and there’ subjected to force
 The force can be against any person - does not have to be against the victim
of the theft.
 There is no requirement that V fears force - B and R v DPP
