What is the Definition of Robbery?
“A person is guilty of robbery if he steals, and immediately before or at the time of doing so, and In order to do so, he uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force”
What is the Meaning of “Steals” in relation in Robbery?
Steals (Immediately before or at the time of doing so)
Can’t fear for the future, there should be an UNBROKEN CHAIN OF EVENTS between the threat or force being used and the theft.
What is the Meaning of “In order to do so”?
Use or threat of force must be ‘IN ORDER’ to carry out the theft.
What does “Uses Force” Mean?
- The slightest use of force to accomplish a theft changes the theft to robbery.
‘ANYTHING BUT NOTHING = FORCE’ - Force must be voluntary not accidental.
What does “On Any Person” Mean?
This refers to a person can use or threaten the use of force on any person or third party which facilitates the theft to take place.
- i.e., “would be for a transport depot manager being threatened in order to stop heavy goods vehicle a number of miles away from a depot so that the contents can be stolen”
What is the Points to Prove for the offence of Robbery?
- Stole property
- Immediately before/at the time of doing so
- And in order to do so
- Used force on a person or put/sought to put a person in fear of immediate use of force.
