What is the Definition of Section 9. 1A Burglary?

A

“A person is guilty of Burglary if they ENTER a Building or part of a Building as a Trespasser with Intent to:

  • STEAL,
  • INFLICT Grievous Bodily Harm,
  • Unlawfully DAMAGE.”

What is a Trespasser Contrary to Section 9 of the Theft Act?

A

A person will be a trespasser when they have entered the building or part of a building without the lawful permission of the owner (To establish Mens Rea the offender must have been aware of this fact). A person who enters with the occupier’s permission will still be a trespasser if they enter for some purpose which they know is outside of the scope of the granted permission.
- i.e., A person went to his father’s house to steal two television sets had entered as a trespasser notwithstanding the fact that he had his father’s general permission to enter the house. His father had never given him permission to enter for the purpose of stealing from inside it.

There will be trespassing where a person moves from a part of the building where they have permission to be two another part where they do not example of this would be a restricted area in the shop
