A

was there force used or threatened?

  • must be sufficient to be noticeable
  • threat of future violence not sufficient
  • (Dawson and James)-word force given it’s ordinary meaning
  • (B and R v DPP)-doesn’t matter if v is actually put in fear or not
  • (Clouden)-does not have to be direct force
  • (Bentham)-threat does not have to be as v imagines if it is intended to cause fear-threat does not have to be real

  • (Hale)-immediately before or at the time-can be satisfied if continuing appropriation
  • (Corcoran v Anderton)-robbery can be committed at the point of appropriationrven though d fails to steal anything
