WHAT DOES CLAUSE 3 HAVE TO SAY ABOUT POLICE POWERS TO BREATH TEST ?
Power to conduct Random Breath Testing upon A person who police have reasonable cause to believe that that person:
- is all was driving a MV on a road
- is all was occupying the driver’s seat of a MV on a road and attempting to put it into motion.
- being the holder of an applicable driver’s licence, is or was occupying the passenger seat in a MV beside a learner driver who was or is driving MV on a road.
What power does section 175 cover in the road transport act?
Power to demand any Driver / Rider to produce their Australian driver’s licence; state his / her name and/or his / her home address.
What power does section 176 cover in the Road Transport Act 2013?
Power to demand front seat passenger supervising a learner to produce licence as per section 175.
