What is the definition of a RTC?
If, owing to the presence of a mechanically propelled vehicle on a road or other public place an accident occurs, whereby:
- Personal injury is caused to a person other than the driver of that MPV, OR
- Damage is caused to another vehicle (other than that MPV or a trailer drawn by it) OR
- Damage is caused to an animal not in or on that vehicle or trailer drawn by it OR
- Damage is caused to any property on land on which the road or other public place is situated, or any adjacent land
What is a mechanically propelled vehicle?
- A vehicle so constructed that it can be propelled mechanically by SEPDOG
What is a motor vehicle?
A mechanically propelled vehicle intended or adapted for use on the roads.
In relation to a MPV, what is SEPDOG?
S - Steam
E - Electric
P - Petrol
D - Diesel
O - Oil
G - Gas
In relation to a RTC, what is a road?
Any highway and any other road to which the public has access, and includes bridges over which a road passes
What is a public place?
Any place to which the public have open access is a ‘public place’, even if payment must be made to gain entry.
What animals are included on the list of reportable animals?

Definition of property
This means property that is:
- constructed on, OR
- fixed to, OR
- growing in, OR
- otherwise forming part of the land on which the road is situated,
- or the land adjacent to it.
What are the duties of a person involved in a RTC?
- MUST STOP
and if required so by any person having reasonable grounds for requiring their: - Name and address and of vehicle if different to driver
- Identification mark of the vehicle
Does the driver have to inform the police?
The driver must report the collision at a police station or to a constable within 24 hrs.
UNLESSS, Their name & address is supplied to any person having reasonable grounds for so requiring it, AND In addition for injury RTC’s – a certificate of insurance is produced to a constable or to any other person having reasonable grounds for so requiring it.
What defence can someone present for not reporting or stopping for an RTC?
If they did not realise the RTC had occurred
What must a driver do for a damage only RTC?
- Stop
- Give name, address and vehicle details
What must a driver do for a injury RTC?
- Stop
- Give name, address and vehicle details
- Produce a certificate of insurance
Does the provisions apply to MPV’s and MV’s?
No, this provision only applies to the drivers of Motor Vehicles only
