What are the two elements for a lawful arrest under s24 PACE?

A
  • A person’s involvement or suspected involvement or attempted involvement in the commission of a criminal offence
  • Reasonable grounds to believe that the person’s arrest is necessary

What 4 things must be told to a person under arrest?

A

1) ARREST: “You are under arrest” (You can specify the offence if you wish)

2) GROUNDS: “The grounds for your arrest are…” (in plain language tell them what you suspect they’ve done; no jargon, no acts or sections!)

3) NECESSITY: “It is necessary to arrest you…” (Code G/SOCAP/COPPLANNED reason)

A

Where there are GROUNDS to believe the person -
* Has made false statements
* Has made statements that can’t be readily verified
* Has presented false evidence
* May steal or destroy evidence…
* May make contact with co-suspects or conspirators
* May intimidate or threaten or make contact with witnesses
