What power under LTA 1998 can you stop a vehicle?
Land Transport Act 1998, Section 114
In what manner must you stop the vehicle?
A: Displaying flashing blue, or blue and red lights
B: Sounding a siren
What does section 114 allow you to demand from the driver?
Full name, full address, DOB, occupation & phone number (or such particulars officer may specify)
Whether they are the owner of the vehicle, if not then provide the name & address of the owner or particulars to identify the owner.
How long must the driver remained stopped under Section 114?
For as long as necessary for you to obtain particulars or excersie any powers under LTA 1998.
If you stop the driver soley for establishing ID you can delay them for upto 15mins for this purpose.
Under section 114 what are your powers of arrest?
A: Fails to stop
B: Refuses to supply details, or you have good cause to suspect details are false or misleading.
What is DIMDFFD under section 113?
Direct - person on a road to give details, information to ID the driver or person in charge of a vehicle
Inspect - test and examine brakes or parts of the vehicle and LT documentation
Move - or authorise another person to move any vehicle if BRGs the vehicle is causing an obstruction or interest of road safety
Direct - the driver or person in charge of a vehicle to remove from the road if BRGs the vehicle is causing an obstruction or interest of road safety
Forbid - an unlicensed driver to driver
Forbid - a person who is operating a toy service vehicle w/o licence to operate tpt service.
Direct - a pedestrian, vehicle or driving an animal on the road stop, keep to a particular live of traffic or direction. ie points duty.
What is Section 115 of LTA 1998?
Banning vehicles from the road
A: Green sticker - BRG vehicle fails to comply with regulations it rules. ie tinted windscren
B: Pink sticker - BRG vehicle is not in a safe condition to be driven on the road ie rust, illegal modifications.
What is Section 118 of LTA 1998?
- An owner or hirer of any vehicle must provide Police with 14 DAYS the driver who was involved in an accident or committed driving offences or passenger who committed or aided in commission on of offence and has avoided arrest against ANY offence on ANY Act.
- An owner or hirer of any vehicle must IMMEDIATELY provide Police with all information available to apprehension & ID of the driver.
What powers does section 116 of LTA 1998 give?
Powers of arrest w/o warrant if you have GCTS person has failed to comply with 113 or 115 of LTA 1998

What is Section 119 of the LTA 1998?
Power to enter a premises to conduct duties of driver or seize vehicle if you have GCTS suspect failed to stop, committed or committing an offence (reckless/dangerous driving) or driving under the influence of drug / alcohol.

Sieze vehicle w/o warrant if you Suspect vehicle is about to be removed, destroyed, concealed, disposed of or SRGs vehicle is about to be used in the commission of a crime.

Why can you seize a vehicle under section 122 and how long for under the LTA 1998?
Seize vehicle for 12hours if BRG that it is in the interest of public safety.
Under section 123 of LTA 1998 how long can you seize the car for and why?
Power to sieze for up to 7 days not exceeding 10 working days IOT;
Perseve evidence
Enable Examination
Establish cause of serious traffic accident
BRG vehicle has been involved in serious traffic offence or hit and run or driver failed to stop
What is Section 95 of LTA 1998
Suspend licence for 28days
- EBA over 650mcg or 130mgm
- EBA over 400mcg or 80mgm & convicted for any relevant offence in last 4yrs
- Failed or refuse Blood test EBA
- Speeding over 40kph in permanent area or over 50kph in temporary area.
