What is s109 of the mental health act?
Any person wandering at large and behaving in a manner that gives rise to believe they maybe mentally disordered in a Public place & member believes it is in the interest of the person.
Detain under 109 take to hospital/cell or other such place.
What is a restricted patient
Patient who are subject to a compulsory treatment order but considered to present a danger to public.
Can return to hospital at anytime if they have absconded.
What is s110 of the mental health act 1992?
Authority by a doctor
Examined and believes they are mentally disordered and it is in their interest for an assessment. Doctor can issue a certificate to accompany the assessment application.
110A - doctor may administrator a sedative if necessary
110C - police power of entry when urgent assistance is needed.
What is a special patent?
Detained by a court order if found to be criminally insane/unfit to plead.
Included people or remand for psychiatric report.
Can return to hospital at anytime if absconded. (not a risk to public)
DAO (duly authorised officers)
Quailifed nurse who has specialised in mental health
Cumpulsory treatment patients
Absent w/o leave or failed to comply under an order maybe apprehended & returned or taken to hospital if apprehended within 3 months of going missing.
What is s41 of the mental health act 1992?
Power to assist DAO.
Enter premises by force if necessary, detain person until the assessment examination has been conducted or take person to a place for the purpose of a medical examination or assessment.
How long can you detain someone under the mental health act 1992?
No more than 6hours for the purpose of a medical examination or assessment.
