What are the aims of restorative justice
. Repair harm between offender and victim
. Improve the experience for the victim and encourage the offender to take responsibility for their crime
What is the restorative justice process
Can be diverse but most share same key features:
- focus on acceptance of responsibility and positive change
- not restricted to courtrooms
What are restorative justice councils
. Independent body whose role is to establish clear standards for RJ
^ advocates use of restorative practice in preventing/managing conflict
^ intersectionality undermines this idea due to their not being sense of equality
Evaluation
Diversity of Programmes (S)
. schemes can be tailored and adapted to needs of individual situation
- counterargument = difficult in drawing conclusions about effective
Expensive (W)
. expensive to implement as requires lots of training
- counterargument = RJC calculated Gov will save £8 for every £1 they spend on implementing RJ
Feminist Critique (W)
. Womens Aid strongly against it for use of domestic abuse and SA as too traumatic
- counterargument = many argue for ‘pro choice’ - women should be granted the choice
