What is the test for relevant parcel?
A
- Contiguous - properties connected, either physically or by design. E.g. - can one property survive/operate without the other.
- Treatment of parcel - has the owner treated the parcel in question as a separate parcel, or treated as one with its other parcels.
- Time of acquisition - acquired at same time or different times? If different times, significantly different?
- Effect of the regulation on the parcel and adjacent land - (not an official factor, rarely used in the cases, professor likes this one). If you can show that the use you want to put on the parcel will have an effect on adjacent parcels, this this could come into effect. Will it benefit adjacent lands and add value? If contiguous and contributes to the value of the unregulated property, then it may be considered a relevant parcel and a taking.
