When do you get a certificate of no effect?
no readily visible effect on the property
When do you get a certificate of appropriateness?
visible effect that the proposed construction would not unduly hinder the protection, enhancement, perpetration, and use of the landmark
When do you get a Certificate of appropriateness on the ground of insufficient return?
provides special mechanisms to ensure that designation does not cause economic hardship.
• Can force the Commission/city to assume the burden of developing a plan that will enable the landmark owner to earn a reasonable return on the landmark sight.
• If plan is rejected, Commission may recommend eminent domain to protect the landmark.
What does transfer of development rights (TDR) allow?
allows the landmark owner to transfer development rights removed from the landmark property to another property. Depending on the state, either must be the same owner, or can transfer to a different developer. (memorize paragraph on this; pg 764-767)
○ E.g. - previous designation allows 60 stories and new only allows 5. Owner has 55 stories of “rights” that they can transfer to another property/developer.
○ Density is the main issue with TDR
What qualifications must members of a historic district commission have?
Historic District Commissions must generally have experts on history, architecture and be familiar with the area.
Special interest, experience, or education in history or architecture (A-S-P Associates).
