What power does the state have over federal lands in the CZMA?
“consistency review” of all federal activities, including the offering of oil and gas leases. State has 90 days to review.
Consistency determination is made by the State. If inconsistent, the Federal Agency head then determines if the activity complies with the State SMA to “the maximum extent possible”. Can overrule with “paramount interest of the United States.”
What is the purpose of the Hawaii CZMA?
Purpose is to preserve, protect, and where possible, to restore the natural resources of the coastal zone of Hawaii.
What are the objectives of the Hawaii CZMA?
Objectives and policies are the protection, preservation, restoration, and improvement of the quality of coastal scenic and open space resources, and the designing and locating of new developments to minimize the alteration of existing public views to and along the shoreline.
