Describe the meaning and 5 conditions of ‏متواتر Hadith

A

Means Mass transmission tava:tur

1) kathrotul isnaad — there must be many chains

there is no specific number of chains some say 3,5,40….

2) it should be narrated by so many people that for all of the yo have conspired or by chance to unite upon a lie would be impossible

3) this number of narrators must be found in every generation of the sanad. Meaning —- large numbers in every sanad

Ex . Wiping on the khuf but some consider it mashhur also

4) last narrator must say clearly that ‘’they saw’’ or ‘’they heard’’ from their sheikh

5) the listener of this Hadith must get the benefit of علم اللي يقيني

But there’s a diff. of opinion in regards to condition no. 5 whether it’s condition or characteristics of mutavaatir Hadith

The only problem that would be is that if any dispute comes about later about the marriage, or whatever may be done in that case, these individuals would not be allowed to give testimony, and they will not be allowed to go in court and get a testimony on behalf of the couple because they’re not eligible, but will they be able to fulfill that aspect of the marriage convening ? yes, they will ! OK

A

And the reason main reason testimony which is taken in a marriage is more for the sake of the woman again, because she is the one that is offering her self her private part so the actual testimony is there for the sharaf and nobility of a woman

But in general, kafir does not have a testimony over a believer
