Receiving (1)
Receives - Exclusively or jointly has possession over anything unlawfully obtained. Helps in concealment or disposal.
Receiving (2)
Any property stolen OR Any property obtained by any other imprisonable offence - Anything that has been stolen/taken that has value and belongs to another person.
Receiving (3)
Knowing that property to have been stolen or so obtained OR Being reckless as to whether the property had been stolen or so obtained - Knowing the property had been stolen or so obtained. Or being reckless.
When is Receiving complete?
Has possession/control over or helps in concealing or disposal of property.
What is Guilty knowledge?
1.Direct evidence - admissions or evidence
2.Circumstantial - I.e. buying property at gross undervalue
Doctrine of recent possession?
If the defendant can’t give a good enough reason to have the stolen property on them.
