Three step process of a referendum

A

Proposed change needs to be approved as a bill by the federal government

It is sent to the Governor General in order for a writ to be issued so a referendum can occur

All eligible voters must vote. And a double majority must occur

76 senators 12 from each state 2 from each territory

Shaped like a horseshoe

The senate acts house of review for any proposed laws, giving a second opinion and making changes after it has passed the House of Representatives

Represents the Australian people

150 members are elected to the House of Representatives

Prime minister must come from this house

Most important role is forming government after an election

Referendum

A

The constitution can only be changed by a referendum

The constitution can only be changed following a certain amount of votes

A double majority is needed

The total yes vote has to be 50% and 1. And 4 out of the 6 states have to have a majority saying yes

Plebiscites

A

Referendums aren’t only held to change the constitution. This is known as a plebiscite

They are used to test public opinions on government ideas or actions

They don’t have legal force unlike referendums.

Example: choosing the national anthem or daylight savings

A

We have the separation of the powers to make it fair and so others can keep a check on each other and make sure everyone is being honest

Parliament: makes and amends laws
Executive: puts the laws into action
Judiciary: makes judgements about the law

A

The constitution is a written document that contains all the rules and laws Australia is run by

Example: chapter 8 section 128is about changing the constitution

Advantages: prevents arguments and disagreements because everything is written down. It is clear

Disadvantages: has to be changed as time goes by
