RA 6969: TOXIC SUBSTANCES AND HAZARDOUS AND NUCLEAR WASTES CONTROL ACT (1990) Flashcards
Significance:
o Enacted to address the environmental and health risks posed by toxic substances, hazardous wastes, and nuclear wastes
o Aims to ensure proper management and control of these materials to prevent harm to people and the environment
Purpose:
o Regulate and oversee the production, importation, and disposal of toxic substances, hazardous wastes, and nuclear wastes.
o Establish guidelines for industries to adopt responsible waste management practices
o Reduce the impact of these materials on ecosystems, communities, and public health
Substances that can cause harm to living organisms through contact, ingestion, or inhalation.
Toxic Substances
Wastes that pose substantial threats to public health or the environment due to their toxic, reactive, flammable, or infectious nature.
Hazardous Wastes:
Radioactive materials resulting from nuclear processes, requiring specialized handling and disposal
Nuclear Wastes:
Concept where manufacturers take responsibility for their products’ entire lifecycle, including post-consumer waste management
EPR (Extended Producer Responsibility):
principle stating that those responsible for pollution are financially accountable for the costs of mitigating its impacts
Polluter Pays Principle
PROHIBITED ACTS UNDER RA 6969
- Unauthorized Handling, Transport, or Disposal
- Importation of Prohibited Chemicals:
- Failure to Establish and Implement Waste Management Programs:
o Subsidiary agency of DENR responsible for enforcing environmental laws, including RA 6969.
o Monitors compliance, issues permits, and ensures proper waste management practices.
Environmental Management Bureau (EMB):
o Principal agency overseeing environmental protection and management in the Philippines
o Develops policies, guidelines, and regulations for the implementation of RA 6969.
DENR
o Responsible for regulating and supervising nuclear and radioactive materials and facilities.
o Ensures safe handling, storage, and disposal of nuclear wastes under the provisions of RA 6969
Philippine Nuclear Research Institute (PNRI):
o Characteristics: Wastes with properties such as toxicity, reactivity, ignitability. or corrosivity that can pose risks to health and the environment.
o Criteria for Classification: Based on specific thresholds and tests for each characteristic, determining whether a waste is hazardous.
Hazardous Wastes:
o Radioactive Waste Categorization: Classified into different categories based on radioactivity levels and potential hazards.
o Management: Subject to stringent controls and specialized handling to prevent radiation exposure and environmental contamination.
Nuclear Wastes:
