PD 1586: THE PHILIPPINE ENVIRONMENTAL IMPACT STATEMENT SYSTEM (1978) Flashcards
Introduced the first EIA
US National Environmental Policy Act (January 1970)
When did the PH follow the US in their initiatives
1977
Landmark law that requires submission of an environmental impact statement on projects and activities that may adversely affect the environment
PD 1151
“No person, partnership, or corporation shall undertake or operate any such declared environmentally critical project or area without first securing an Environmental Compliance Certificate”
Section 4 of PD 1586
Process that involves predicting and evaluating the likely impacts of a project (including cumulative impacts) on the environment during construction, commissioning, operation, and abandonment
Environmental Impact Assessment
includes designing appropriate preventive, mitigating and enhancement measures addressing these consequences to protect the environment and the community’s welfare
Environmental Impact Assessment
responsible for determining and disclosing all relevant information necessary for a methodical assessment of the environmental impacts of their projects.
Project PROPONEN
aids PROPONENTS in incorporating environmental considerations in planning their projects as well as in determining the environment’s impact on their project
The EIS System
concerned primarily with assessing of a project on the biophysical and human environment and ensuring that these impacts are addressed by appropriate environmental protection and enhancement measures
EIS System
Proclaiming Certain Areas and Types of Projects as Environmentally Critical and within the Scope of the Environmental Impact Statement System Established Under Presidential Decree No. 1586
PROCLAMATION NO. 2146 s.1981
ECPS
Environmentally Critical Projects
ECAs
Environmentally Critical Areas
Included golf courses as ECP
PROCLAMATION NO. 803 s.1996
Incorporating Disaster Risk Reduction (DRR) and Climate Change Adaptation (CCA) Concerns in the Philippines EIS System
DAO2003-30
Revised Guidelines for Coverage Screening and Standardized Requirements under the PEISS
EMB Memorandum Circular
No. 2014-05
Guidelines on Public Participation under the PEISS
DAO 2017-15
Criteria of Project Classifcation base on EMB MC 2014-005
o Project type
o Location
o Nature of potential impact
PROJECT CLASSIFICATION A (based on EMB MC 2014-005, 07 July 2014)
ECP (ECC required)
PROJECT CLASSIFICATION B (based on EMB MC 2014-005, 07 July 2014)
Projects within ECA (ECC required)
PROJECT CLASSIFICATION C (based on EMB MC 2014-005, 07 July 2014)
Project that enhances the environments
PROJECT CLASSIFICATION C (based on EMB MC 2014-005, 07 July 2014)
Projects unlikely to cause significant adverse environmental impacts
LIST OF ENVIRONMENTALLY CRITICAL PROJECTS (ECP)
Heavy Industries
Resource Extractive Industries
Infrastructure Project
Al golf course projects (from Proc No 803)
LIST OF ENVIRONMENTALLY CRITICAL AREAS (ECA)
- national parks, watershed reserves, wildlife preserves, sanctuaries
- aesthetic potential tourist spots
- habitat of endangered or threatened species of Philippine wildlife
- unique historic, archaeological, or scientific interests
- traditionally occupied by cultural communities or tribes
- frequently visited and for hard-hit by natural calamities
- Areas with critical slopes
- prime agricultural lands
- Recharged areas of aquifers
- Water bodies (domestic use, protected areas, supports wildlife and fishery)
- Mangrove Areas
- Coral Reefs
Project Status based on Status
- New
- Existing without ECC (prior to 1982) but with expansion/modification
- Existing with expansion/modification
documentation of the actual cumulative environmental impacts and effectiveness of current measures for single projects that are already operating but without ECC’s
Environmental Performance Report and Management Plan (EPRMP)
documentation of actual cumulative environmental impacts of co- located projects with proposals for expansion
Programmatic Environmental Performance Report and Management Plan (PEPRMP)
document similar to an EIS, but with reduced details and depth of assessment and discussion
Initial Environmental Examination (IEE) Report
simplified checklist version of an IEE Report, prescribed by the DENR, to be filled up by a proponent to identify and assess a project’s environmental impacts and the mitigation/enhancement measures to address such impacts
Initial Environmental Examination (IEE) Checklist
document, that describes the nature, configuration, use of raw materials and natural resources, production system, waste or pollution generation and control and the activities of a proposed project.
Project Description Report (PDR)
document issued by the DEN/EMB after a positive review of an EC application, certifying that based on the representations of the proponent, the proposed project or undertaking will not cause significant negative environmental impact
Environmental Compliance Certificate (ECC)
certification issued by the EMB certifying that, the project is not covered by the EIS System and is not required to secure an ECC
Certificate of Non-coverage (CNC)
contain an explanation for the disapproval of the application and guidance on how the application can be improved to a level of acceptability in the next EIA process
Denial Letter
BASIC CONTENTS OF ECC
- Scope of project or undertaking
- Conditions conformed by the proponent to implement mitigating measures for potentially negative impacts and enhancement measures for potentially positive impacts
- Recommendations to concerned permitting, deciding and monitoring entities
Once project is implemented, ECC remains valid and active for _______ of the project (unless otherwise specified)
lifetime
For Non-ECP, _________ has the authority to issue ECC
the DENR-EMB Regional Office
ECC expires if the project is not implemented within ________ from ECC issuance
5 years
Within ___________ to the expiration of the ECC, a letter for extension can be requested to extend the validity of the ECC
3 months prior
New ECC is unnecessary if baseline characteristics have significantly changed to the extent that the impact assessment which was the basis of the EMP is no longer appropriate
T or F
F, its still necessary
Max Processing Time frame for ECP
120 days for AO 41; 40 days for MC 2010-14
