who can request EJJ Designation?
A
The state or juvenile’s attorney can EFF Designation if at the time of the ofense the juvenila is:
- age 12 and under and charged with capital murder or 1st murder; howver the state has to prove fitness and capacity to proceed according to EJJ guidelines
- age 13 and under charged with capital or first degree murder; however the juvenile has toprove lack of fitness
- age 14 & 15 charged with any of crimes listed in A.C.A.9-27-318 (see big 7)
- 13 and under tried in juvenile court
- 14& 15 in juvenile court UNLESS it’s Big 7 (Adult court)
