Physical therapy definition
Article 1: Administration
Priority of board: protect public
Members: 1 PT for education, 3 with 5 yrs experience, 3 public members serve for up to 2 terms of 4 years in a row
Duties: request documentation, issue/suspend licenses, inspect forms, meet annually
Article 2: General Provisions
CAN: apply topical medication, perform tissue penetration for neuromuscular evaluation with authorization and certification, hold records 7 years after d/c
CAN’T: use radioactive rays to diagnose or treat, diagnose disease, prescribe medication
Article 3: Licensing of Practitioners
PT Aides:
- 1:1 ratio for patient related tasks (service rendered directly to patient)
- Non-patient related tasks (observation, transport, transfer support, clerical duties) can be more than 1:1
- At all times under PT supervision if immediate support needed
Licenses:
Board approves all applications, given title DPT
Required to pass law, national boards, education requirements, >18 years old, no substance abuse or crimes
Foreign Applicants:
Can get license if previous license above CA, graduated from program, has PTLA, and met all requirements
PTLA: 90 day limit only one after applying for liscense, can work as PT under licensed PT
Article 4: Educational Standards
Schools accredited by CAPTE or APTA include clinical courses and 18 weeks of clinical
Students use “student” or “intern” if didactic courses have been taken
Foreign students need to submit documentation of equivalence, exam completion, and 9 months of clinical service under PTLA to be approved
Article 4.5: PTA
Can be 1 PT to 2 PTA (more if board allows) but total at clinic is 2x
Requirements: graduate program, pass exam, no substance abuse or crimes
Can work as PTAA with same requirements as PTLA
Article 5: Suspension, Revocation, Reinstatement of License
Suspend or revoke it: fraud, aid criminal abortion, conviction of crime, substance abuse, negligence, violating practice act of Medical Practice Act, knowing failure to protect from infection, sexual or verbal abuse
Board can refuse or give prohibitory license as deemed
Public letter of reprimand: notifies license 30 days prior to filing, they have 15 days to respond
Reinstatement if have 2 letters of rec and not under criminal offense with various periods of probation:
- Unprofessional conduct: at least 3 yrs probation
- Probation of >3 yrs: at least 2 years probation
- Mental/physical illness <3yrs: >1 yr probation
Article 5.5: Diversion Program
Diversion committee: 3 or more members with >3yrs knowledge in substance abuse/psych area with terms <4yrs who are tasked to evaluate/recommend facilities, decide if safe to resume PT, and hold 2x/yr meetings
Acceptance into program: licensed, substance abuse, voluntarily requests admission, undergoes exam, cooperates with program
Termination of program: completed, failed to comply, not benefiting, fails to meet criteria
Article 6: Offenses and Enforcement
Violations of this charter are misdemeanor <1,000 or <6 months jail issued by supreme court via CMA, PT board, or >10 PTs
Article 6.5: Continuing Education and Competency
Continuing education must be completed 30 hours every 2 years and can be fulfilled by postsecondary degree or exams/classes
Article 7: Fiscal Administration
Licensed approvals expire at midnight of last day of birth month every 2 years
Submit form, fees, and CEUs upon renewal within 5 years of previous license for various fees
Article 8: Physical Therapy Corporations
PT corporations are authorized to render PT services if they comply with Moscone-Knox Professional Act
Corporations must have PT in the name and licensed shareholders
