A

A PSO is used when you believe it is necessary to to take action to ensure the safety of a person at risk ad there is insufficient evidence to make an arrest.

  • Any child residing with that person. (includes children of the person whom the order is to be issued against whether the person at risk is also a parent or not).

Police do not need the consent of a person at risk to issue a PSO, Therefore the person at risk can not be blamed for the actions taken by the Police.

A

Before a PSO is issued, is must be authorised by a qualified constable who is at the rank of sergeant or above.

If the arrest is for a family harm offence you cannot issue a PSO. You can however ask for bail conditions similar to the conditions of a PSO.

  • Issue a temporary Protection Order. The bound person can be detained for no more than two hours to allow the temporary Protection Order to be served.
