Marital Property
Anything acquired during the marriage by either spouse or both together. Also, any benefits/interest that accrued during the marriage, even if the account was created prior to the marriage. And an enhancement or appreciation of a non martial asset through the effort or contribution of one or both spouses.
Nonmarital Property
Property acquired prior to the marriage and kept separate.
Equitable Distribution
Marital assets are subject to equitable distribution in Florida. The presumption is a 50/50 split of marital assets based on several factors, including each spouses contribution during the marriage, the duration of the marriage, the economic circumstances of each spouse, and the economic sacrifices of the spouses.
