What are the powers of arrest for street offences?
Any police officer may arrest, without warrant, any person found offending against of the provisions of part A, B, C, Ca, D
What do you have to do if you are going to give someone a formal direction?
- Identify yourself as a police officer, ascertain name and address of offender
- Direct person to leave public place (specify by boundaries)
- State the reason for the direction
- Specify the duration of the direction
- Inform of consequences of refusal (arrest/prosecution)
- Ensure direction is understood
- Notify VKT

Define possession
A controlled substance is taken to be in a person’s possession for the purposes of this act so long as it is:
- On any land or premises occupied by the person
- Or is enjoyed by the person in any place
- Or is in the person’s order and disposition, unless the person proves that he or she had no knowledge of the substances (reverse burden of proof)
