What are the relevant bits of the data protection act 1998
Section 7a - individual is entitled to be told what is going on with their data
Section 7b - data controller must provide a blurb about the data, why they have it, and who also has access
What is the relevant bit of the access to health records act 1990
Section 3(1)(f) - access to a dead persons records is granted to their NOK
What is the relevant part of the medical records act 1988
patient is allowed access to their medical records at any point
patient is allowed to refuse consent to disclose a medical report to employer or insurance company
When are you allowed to withhold medical records
- if knowledge will cause serious harm (data protection act)
- if it’s too hard to get hold of (data protection act)
- if they are restricted by a court order
what is coercion
- one person intentionally uses a serious / serious sounding threat of severe harm or force in an attempt to control someone else
- only counts as coercion if it was successful
- feeling threatened doesn’t count - threat must be real + explicit
what is persuasion
- person a believes something because person b is very convincing
- appeal to reason
- appeal to emotion
what is manipulation
- generic term for forms of influence that are not persuasive or coercive
