Q

How is politicisation by President a problem?

A

. Presidents are tempted to nominate and appoint a justice whose political and judiciary philosophy match their own.

. As a result the Supreme Court can be heavily influenced by a president and as a result may aid certain judicial events involving either the president or a member of his ideology.

Q

How is politicisation by the Senate a problem?

A

. The defeat of Robert Bork is a perfect example of the Senate politicising the political process and bringing in external political factors.

. Democrat opponents on the Senate Judiciary Committee mobilised an array of liberal interest groups to oppose Borks nomination.

. Even a television advertising campaign was mounted against his nomination therefore bringing in the politicised media.
