Judge orders exam of mental, physical or emotional condition of pt

DV, sexual assaults, stalking
victim has right to refuse do disclose info in course of safety planning, counseling, support or advocacy services
Records created/maintained during services to victim
Non-custodial parent rights
can inspect/receive school records re welfare and education
law/gov. agency records
consult with person providing care or tx - medical, dental, psych records
authorize ER tx if custodial parent unavailable
apply to see child’s conservator, guardian ad litem or both
parents for consent

Rights of minor - age of consent
14 years of age or older
Minor tx types
outpatient chemical dependency (not methadone)
Minor parent involvement
before the end of tx unless refused by parents or clinically indicated not to
Does not apply to sexual abused by parent or emancipated minor or self sustaining child for 90 days
Minor tx can be disclosed when
when clinically appropriate, condition deteriorated, risk of suicide, if inpatient tx necessary, detoxification required
