if person poses risk of harm or danger to self or others and failure to commit would cause this
Timelines
If person in custody before investigation, investigation complete 24 hours before hearing
3 judicial days person w/ mental illness notified if can be located
15 day from date notice, program director complete report and submit to court
Commitment hearing
within 5 days from court order
can be in hospital
Commitment Time
w/in 72 hours of admission, investigation must be initiated
Can’t be held for more than 5 judicial days. Court may allow a postponement.
Voluntary
Person voluntarily committed must be released w/in 72 hours or request for release
