Pre-Project management Flashcards
Who typically determines the composition of the project team? how?
client owner or the prime consultant
by determining what disciplines are required to accomplish project objectives
Who are the basic team members of a project
the owner, the contractor / consultant and the sucontractor/ sub consultant
What role does the owner play
initiates a project and will take title over the proj when it is completed
What is the role of contactor or consultant
hired by the client to provide labor or services
sometimes called the prime
a consultant is defined a party that evaulates the clients needs and provides expert advice (design) on how they should be met whereas a contractor will perform the built ‘ actual work
what is the role of a subcontractor / subconsultant
hired direct by contractor or consultant to provide necessary services that the contractor or consultant does not have in house but is needed to complete a given SOW
What are three types of business organizations (private sector) engaged in design. why is this relevant?
sometimes state or other gov’t entities will require that work be provided by a specific form of business organization
three common are
proprietorships - owned by an individual
partnerships - association of two or more people who conduct biz as a single entity - members have joint control
corporations - form a biz that is distinct / separated - in mgmt, legality and tax ect - from the owners personal obligation
define a contract
the professional practice of landscape arch defines contact as
the legal document that sets forth the obligation so reach parties to the contact and specifies the duties and responsibilities of th entities that sign the contract
What are the four basic contracting methods (not to be confused with costing contract
general contract method
design build
separate contracts
self performance-
what isdesign-build
the consultant and the contractor are the same entity / firm or organization
What is separate contracts method
multiple primes method aka
eliminates prime contractor or consultant as middle man.
What is the general contracting method of contracting projects?
contractor and designer are separate - subs do not have direct line to client
what is the self performance contracting method
the contractor will conduct the entire scope of work in house without any outside or sub consultants. typ for projects of small scope and simple
What is “estoppel”
is a principle by which a contract becomes binding in spite of the fact that no formal agreement was made between the parties concerned. says an agreement exists based on behaviors ect where no formal contract was created
What is the most common type of contract used by LA professionals
professional services contracts
What are the 8 standard elements of a professional services contract?a, d , s, s, r, f(b), tnc, s
agreement between contracting parties
description of proj,
scope of work - written descrip of project - budget code, etc
scope of services - list of tasks, design budget and workload are based of SOS
responsibilities of the parties to the contract - outline responsibilities not covered in the scope of services
Fees - fixed ‘ lump sum OR hourly OR Multiplier (estimated hours x rate) OR. % of construction
Terms and Conditions - boiler plate language from well vetted standards contracts
signatures
Contracts for design services typically fall into one of what three categories?
lump sum/fixed fee
time and materials
cost plus fixed fee
What is a lump sum fixed fee contract
complete scope of design services in a contract for a mutually agreed upon fixed sum of money. payment for services typically based on % submittal phases and deliverables
What is a time and materials fee structure
when is it used?
what does it establish, NTE
hour labor rates are negotiated and established in advance.
best when full scope of work is hard to anticipate
Maximum not to exceed typ cinluded
What is a cost plus fixed fee cost structure
covers the cost labor and materials of a design without accounting for profit - profit is negotiated as part of a fixed fee that does not vary regardless of actual costs incurred
With regard to proposal - what is an RFI
request for information - used during construction admin - provides general description of service required by an owner and request that interest desing firms reply with a statement of interest
with regards to proposals - what is an SOI
statement of interest - confirms that design firm is interested in proposed proejct
With regards to proposals, what is an RFQ
request for qualifications
get design firm shortlisted / prequalified proposals
What is an SOQ
statement of qualifications - response to an ROQ. includes key info on design firm key information, capabilities and resources
What is an RFP?
Similar to RFQ, however it additionally outlines scope of work and services to be provided
