Approach looking beyond boundries and normal definitions, looking at harm, dont just look at law-breaking.
2 types of harm in transgressive approach
- harms of reduction- power used to cause victim to experience some immediate loss or injury
- Harms of repression- power used to restrict future human development. Harms brings wider range of actions into criminal net, threatens human dignity and respect e.g. Sexual harassment and hate crime
Hate crimes
Perceived by victims or any other person to be motivated by hostility or prejudice based on persons ethnicity, religion, sexual orientation or disability
Main idea
Argue society is changing so rapidly and constantly that it’s now marked by uncertainty and risk. View category ‘crime’ as socially constricted based on narrow legal definition reflecting outdated metanarrative.
Causes of crime
- Marginalisation
- Relative deprivation
- Anomie and strain
- Weakened social bonds

Katz explored pleasures and seduction of crime, whilst Lyng studied edgework
Evaluation
- Fails to recognise people still have strong conception of right and wrong
Control and prevention of crime
-Argues a need for CJS to recognise diversity of social groups and their respect to their particular social identities and lifestyle choices, such as police becoming more sensitive and tolerant on ethnic minorities and gender identities
