What is a Police Safety Order?

A

A PSO is an order issued by a constable using the prescribed form

A

If you arrest someone for a non family violence offence you may still issue a PSO if you have necessary concerns for the safety of a person at risk and any children residing with him or her.

Police do not need the consent of the person at risk to issue a PSO. By not requiring their consent we are able to avoid the person at risk being blamed for police action.

Any weapon in his/her control (including Firearms)

Any Firearms Licence held

A

There is no offence for breaching the order

What can we do if a bound person breached a PSO?

A

When a bound person breaches a PSO, a constable may without Warrant using reasonable force take the person into custody and bring him or her before the district court.

If the person who has been taken into custody can’t be brought before the District Court within 24hrs, they must be released and served with a summons.

What will the courts do?

A

When dealing with a breach the courts may:

Release the bonded person with no further action

Direct police to issues another PSO

Issue a temporary protection order

When can you arrest a person with regard to a PSO?

A

Arrestable Offences

Fails or refuses to remain at a place where they are detained

Fails to comply with conditions of PSO

When arresting consider WEEP

W = Witness safety, or preventing interference with
E = Ensure the Bound Person appears in court
E =Evidence protection or preventing loss/destruction of
P = Prevent further offences from occurring.
