What is a Motor Vehicle?
Means a vehicle drawn or propelled by mechanical power (including a trailer and a vehicle being towed.)
What is a Road?
Street, motorway, beach, bridge, culvert, or anything forming part of a road/street etc.
Or a public place where people have access
What do we mean by Operate?
Drive or use a vehicle on a road or permit a vehicle to be driven on a road whether or not the person is present.
An Inconsiderate driver is?
Inattention or thoughtless/deliberate actions, i.e. low speed, not stopping for long queues. (No power of arrest)
A Careless driver is?
Falling below driving standards, i.e. Fail to indicate or colliding with legally park vehicle. (No power of arrest)
A Dangerous driver is?
Manner or speed dangerous to anyone, i.e. overtaking into on coming traffic, 80 in a school 40.
A Reckless driver is?
Knowingly & deliberately running an unjustifiable risk of injury or collision, i.e. hitting a stop at 80 or trying to outrun a patrol car at night and turning lights off.
What is an ION
(ION) or INFRINGEMENT OFFENCE NOTICE
Used for offences like speeding, seatbelt, licence, WOF etc. Carries a monetary value, pay if you are pleading guilty to the charge. This saves protracted court cases.
What is a TON?
(TON) or TRAFFIC OFFENCE NOTICE
For more serious offences like careless use of a motor vehicle, or dangerous driving. A 19B Summons loaded within 7 days and driver is prosecuted against in court.
CRASH LAWS
Under Section 22(1) – LTA 1989, what are a drivers Initial responsibility?
Where a crash arising directly or indirectly from the operation of a motor vehicle occurs to a person or vehicle the driver or rider MUST
STOP their vehicle
ASCERTAIN whether anyone is injured
RENDER any practical assistance to anyone injured or killed.
CRASH LAWS
Under Section 22(3) – LTA 1989, A driver has a duty to report injury when?
Where an accident involves INJURY or DEATH the driver MUST
Report the accident IN PERSON at the NEAREST POLICE STATION OR TO AN ENFORCEMENT OFFICER
As soon as reasonably practicable, AND NOT LATER THAN 24HRS AFTER THE TIME OF CRASH
Unless INCAPABLE OF DOING SO DUE TO INJURY sustained in accident (i.e. at/in hospital)
CRASH LAWS
Under Section 22(3) – LTA 1989, A driver has a duty to report damage when?
Where an accident involves damage to an unoccupied vehicle or another person’s property the driver MUST
REPORT within 48hrs to the owner their name, address, rego, crash location, or
If the owner cannot be found, report to the police within 60hrs
Unless incapable of doing so due to injury sustained in accident (i.e. at/in hospital)
