What are the 2 key aspects of policy and legislation which govern the planning system?
- Localism Act 2011
- NPPF
What is the Localism Act 2011?
- Neighbourhoods to benefit from CILs
- Developers are obliged to consult local communities and have regard to their vewis raised before submitting major planning applications
What is the NPPF?
Sets out the UK government’s planning policies for England and how they should be applied to achieve sustainable development (in accordance with UN sustainable development goals)
Key policies include:
- streamline planning process
- local plan system
Consultation process ended Sep 2014. No timetable yet for the propsed new legislation
What is the definition of development as set out in the Town and Country Planning Act 1990?
“the carrying out of building, engineering, mining or other operations in, on , over or under land, or the making of any material change in the use of any buildings or land”
What are the 2 types of planning applications?
Outline application - to establish the princple for development
Full applciation - for full consent
Describe outline planning application
The consent will require the submission of a further applciation for reserved matters which must be contained in the subsequent detailed application within 3 years.
Once the last reserved matters have been approved there is usually a 2 year period within which development must commence.
Describe a full planning application
Usually lasts for 3 years from consent. The conditions attached must be reasonable.
What is a Section 106 agreement?
Legally binding agreement enforceable by the LPA and are site specific impact related only.
Examples:
- new school
- community facility
- open space
What is CIL?
Used by CPAs for off-site payments from developers to raise funds for infrastructure necessary to support development in the area
Examples:
- Roads and transport facilities
- medical and sporting facilities
- new school / open space
What are the main differences between section 106 and CIL?
Why were the use classes in England updated in 2020?
Aim was to allow businesses more flexibility in what buildings can be used for
What are the new use classes in england?
Class B - Industrial
Class C - Residential
Class E - Commercial, Business and Service
ClassF - Local Community and Learning
What are permitted development rights?
For some development, planning permission is not required and there are now many permitted development rights for change of use.
Most notably, right to change from Class E (Commercial) to Class C3 (Residential - Dwellings).
What is an Article 4 direction?
Issued by LPAs in circumstances where specific control over development is required.
What is the Neighourhood Planning Act 2017?
Chnges to strengthen neighborhood planning, aiming to free up more land to build houses and speed up the planning process to enable more houses to be delivered i.e.
- Steamlining CPO procedures
