If interrogated, what time of day shall it happen?
SHALL be conducted at a reasonable hour, usually during normal shift. If it is a serious investigation, it can be done anytime, but OT SHALL be paid.
What do you have the right to know about the investigators prior to interview?
The nature, name, rank, and command.
Can you record your interrogation?
Yes. You also have the right to post interrogation notes, reports, and complaints other than confidential.
Can your home address or photo be given to the media?
Not without your consent.
When can uniformed members engage in political activity?
Off duty and out of uniform.
How long does the Dept have to complete an investigation?
Except as provided by statute, no punitive action, nor denial of promotion shall be taken for any allegation of misconduct if the investigation is not completed within one year of agencies knowledge of the allegation.
Are you allowed to review documents containing adverse comments prior to them being placed in your folder?
You have the right to review and sign it first.
If an adverse document is placed in your folder, how long do you have to file a response?
30 days.
When are you allowed to inspect any of your personnel files?
Anytime during your normal working hours.
What could happen if you refuse to submit to a polygraph or voice stress analyzer?
You may not be requested or compelled to submit, and no disciplinary action may be based on your refusal.
When can your locker or work area be searched?
Only when you are present, OR you have given consent, OR you have been notified a search will occur, OR a search warrant has been obtained.
