No person may operate an aircraft in controlled airspace under IFR unless that person has filed an IFR flight plan and received an appropriate ATC clearance.
What is the ruling regarding taking off into IMC in uncontrolled airspace?
Taking off into IMC in uncontrolled airspace without a clearance or a release has been ruled by the NTSB as a violation of §91.13, careless or reckless operation.
