s1(3) occupier owes a duty if:
(a) aware of danger or has reasonable grounds to believe it exists
(b) knows/ reasonable grounds to believe non-visitor is in vicinity of the danger of may come into existence with risk vicinity of the danger
(c) Reasonably be expected to offer non-visitor some protection
