What is section 1 of the prevention of crime act 1953?
Any person who without lawful authority or reasonable excise, the proof of which shall lie on him, has with him in any public place any offensive weapon shall be guilty of an offence.
What is an offensive weapon?
Any article made or adapted for the use of causing injury to a person, or intended by the person having it with him for such use by him or some other person
Define made?
An article specifically made for causing injury and have no other practical purpose e.g knuckle dusters
Define adapted
Anything where the article has been altered in a physical way for causing injury e.g broken bottles and glass
Define intended
Something otherwise inoffensive which the person intends to use to cause injury e.g baseball bat
What is instant use?
An incident that comes about through instant use of an innocent article at hand
What is section 6 of the offensive weapons act 2019?
A person commits an offence if they have a corrosive substance with them in a public place.
