what resposibilities does the OC suspect have whne an alibi is put forward by an offender where proceedings have been commenced?
its the responsibiitly of the OC to make thorough enquires to determine the veracity of the alibi and fully report the result of these enquires to the crwon,
Must make enquiries of people other than the person who details have been supplied to confirm or rebut evidence in support of the alibi
complete enquiries to establish where the suspect was at the time of the offence, who they were with and what they were doing
coroboration of the alibi provided by the suspect should be sought from forensic or other sources that are independant of the suspect.
What are the OC suspects responsibilities
Supervising member of the suspects team for the purpose of:
* obtaining information abut suspects and person of interest as they are ID’d by OC investigation
* thoroughly profiling and investigating all suspect and person of interest to enable OC investigations to establish their involvement in the offence or eliminate them
*seek evidence to cover all ingredients of the offence
*mitigating and dealing with possible defences that may be raised
* providing a basis for further investigation
Interviewing a suspect, the OC must ensure the interviewer ???
is conducted in accordance with the investigative interviewing suspect guide
is monitored by a supervisor or experienced deective to ensure all key point are covered
ensure an explaination is sought from the suspect in relation to exhibits found
A Dr may examine a suspect, what must the Dr do
Note any injuries, such as scratches or bruises
Takes samples identified as necessary by OC Investigation using a specialist medical examination kit including
*blood
*saliva
*head hair
*pubic/body hair if relevant
*fingernail scrapings
*swabs of suspects hands or other relevant areas
Swab suspect hands for firearms residue using specialist firearms detection kit, as soon a possible where a FA has been involved ( may be present for up to 3 hours)
Provide a professional opinion regarding the condition of a suspect.
during an investigation into multiple suspects, what steps can be taken to mitigate or eliminate the possibility of forensic X contamination
an appreciation as to which staff member is to seize clothing from suspects, important that officers involved are fully aware of X contamination issues and if possible separate officers to be assigned to each suspect.
Suspects to be kept apart including travelling and when in cells
All clothing should be packaged, labelled and sealed in accordance with standard procedures before transfer to OC exhibits.
As OC suspects, what should you record when you observe injuries on the suspect
record any explanations or comments made by the suspect about the offence or cause of injury
Photographs of the suspect and any relevant marks/injuries must be taken
OC Suspects must investigate all suspects thoroughly in order of priority as decided along with OC investigations.
What particular matters may influence the setting or priorities?
The relative weight of evidence against a person or likely hood of their leaving the area
A particular urgency in solving the case or the availability of staff.
Where no lines of enquiry, priority should be given to anonymous information, (especially in the early stages) about the suspects ID must be acted upon immediately.
4 Matters to cover cover when briefing the suspects team
- the circumstances of the offence including the analysis of the scene and witness evidence
- the full details of all persons of interest or any suspects, where the ID of the suspect is known
- details of any description of the suspects provided by witnesses
- whether any particular MO/Crime signature have been ID’d
