State Nurse Practice Act
Each states Board of Nursing has a Nurse Practice Act which defined the scope of practice for nurses licensed within the state.
What is the Board of Nursing?
The Board of Nursing is generally a state-based department responsible for licensing nurses, developing standards and scope of nursing practice, and outlining disciplinary action.
What is the most common reason that nurses have their license revoked?
Stealing narcotics for personal use or intentionally harming patients.
How do most states program for impaired nurses work?
Most impaired nurse programs allow a nurse to receive rehabilitation, without losing their license if they admit they have a substance abuse problem.
What is the NLRB?
The National Labor Relations Board is a federal agency that manages the NLRA.
What is the purpose of the NLRA?
The National Labor Relations Act (aka the Wagner Act) of 1935 was developed to provide protection for workers to form, join, assist labor unions; collectively bargain for higher wages and better working conditions; and it created rules for acceptable employer behavior during unionization efforts.
What is collective bargaining?
IT is a negotiated agreement between the labor union and the employer for union members focusing on healthcare, working hours/conditions, wages, vacation time, and other benefits.
What is the grievance procedure.
Negotiated during collective bargaining to solve disputes between employee and employer
What is the difference between Grievance and arbitration?
When a grievance cannot be resolved, it moves to arbitration where a hired impartial third party reviews all details of the grievance and gives a final award.
What are the steps permitted to unionize a workplace?
1.) attend meetings during non-work time to discuss joining a union.
2.) Talk about the union wherever other non-work talk is allowed.
3.) Read and distribute union literature as long as it is in non-work areas during non-work times such as breaks, lunch hours or before or after work.
4.) Sign a card or petition to show support for a union.
If a manager suspects union activity is going on at their facility, what are they permitted to do.
