Is NHRC a constitutional body?
No, its a statutory body created by Protection of HR Act 1993
When was it established?
1993
What does it do?
Its the watchdog of HR in India
What are the objectives of NHRC?
- to strengthen institutional arrangements through which HR issues can be addressed
- to look into allegations of excesses (independently of govt)
- to complement and strengthen efforts that have already been made in this direction
Composition
Chairman + 5 Members + 7 ex-officio Members
Chairman Qualification
Retired CJI or SC judge
Qualification of other 5 members
1 serving/ retired judges of SC + 1 CJ of HC + 3 persons w/ practical experience in HR (1/3 should be a woman)
Appointment of Members
By President w/ recommendations from 6 mem committee
= PM, Speaker of LS, Deputy Chairman of RS, leaders of Opp (both Houses), Central Home Min

Sitting judge can be app only after consultation w/ CJI
Tenure
3 years / 70 years whichever is earlier

Not allowed u/ Central or State govt
Who can remove members?
President
When can mem be removed?
- adjudged insolvent
- engages in paid employment outside duties of his office
- unable to continue b/c of infirmity of mind or body
- unsound mind declared by a competent court
- convicted and sentenced to imprisonment for an offence
- proven misbehaviour/incapacity = should be referred to SC
Functions
- inquire into violations of HR/ negligence by pub servant= suo moto, order of Court, on a petition
- intervene in any proceeding related to HR
- visit jails & detention centers= study living conditions
- review constitutional + other legal safeguards for protections of HR
- revies factors including acts of terrorism that inhibit enjoyment of HR
- study treaties + internat instruments on HR
- spread HR literacy
- u/take + promote research in HR
- encourage efforts of NGOs in HR
