What is child support?
Financial support you provide to your child by paying it to the other parent
What helps us make decisions on who pays child support and the details?
Child support Guidelines - exact rules and exact amounts you have to pay
What is the goal of child support?
To make sure that children are provided for and that both parents are taking a fair share of the responsibility
What are the two types of child support?
1) Base or table (s3) = a set amount to cover basic expenses
2) Extraordinary Expenses (27) = expenss that are for a particular child beyond the basics
What are the 4 Extraordinary Expenses
Child care
Medical / dental
Extracurricular
School expenses
What are the two types of parenting
Primary and Shared parenting
How does child support work for Primary parenting
If a parent has the child for more than 60% of the time they are the primary, and are known to be the recipient (the other parent is the payor)
They are entitled to basic child support
To determine what the monthly amount the payor has to pay requires three steps, what are they
1) calculate the payors income ex.their tax return
2) Determine the number of children and which province
3) Look at the right table (in the regulations) that is based on 2
When it comes to “Shared parenting” how do you decide who pays what?
You look at the amounts each parent would have to pay if the other person was the primary parent, then set those two numbers off against each other
What do extraordinary expenses need to be?
Reasonable.
A wife cant enroll her kid in 20 different activities and expect money for it
For extraordinary expenses, each parent pays their share in proportion to their income, what does this mean?
Both parents combine their income, if julio contributes to 1/3 of that combined income and rebekah contributes to the 2/3 of the combined income.
Then Julio has to pay 1/3 of the extraordinary expenses and Rebekah has to pay 2/3
What is partner support?
Where one partner pays for support for the other partner after divorce
What are three factors to consider when determining entitlement to partner support?
1) Length of cohabitation
2) Functions of each party
3) Any order of agreement
The clearest case of entitlement to spousal or partner support is
1) When one party was a stay at home parent in a long relationship,
2) Or if the parents agree upon splitting up that one parent is gonna continue to be a stay at home parent
How do you calculate spousal support?
